Commercial, Contractual and Regulatory aspects of Hydropower and Water Resources

Chris Head & Associates is a small consultancy specialising in providing high-level strategic advice on the development of hydropower and water resources projects. We have an established track record of working for public and private sector clients on schemes in Africa, Asia, Europe and South America. Many of the projects involve major multi-purpose dams. Our experience covers a wide range of ownership models from private IPP companies (Independent Power Producers) to hybrid Public-Private Partnerships (PPP).

The principal areas of our activity are:

  • Private Hydropower
    • Concession agreements
    • PPA and power trading
    • Contracts, risk analysis
    • Project Structuring/financing options
    • Privatization of existing hydro assets
  • Public-Private Partnerships
    • PPP Structuring
    • Risk management and risk allocation
    • PPA and Concession terms
    • Public and private sector roles
  • General
    • Construction models (EPC, multiple contracts)
    • Procurement protocols
    • Water resources management
    • Dispute resolution
    • Capacity building, institutional development

With growing involvement of the private sector in what was previously public infrastructure, the contractual arrangements surrounding hydropower and similar projects have become increasingly complex. The public sector role has changed; there are now more parties involved and much greater commercial accountability, with a strong awareness of environmental and social factors. For a successful outcome a careful balance has to be achieved between the interests of the many stakeholders involved.

Based on many years experience in the planning and development of such projects, we offer clients impartial advice on the commercial, contractual, and regulatory aspects of hydropower and water resources development.
